How to Protest Your Property Tax Appraisal Value

In the Arlington, Dallas and Fort Worth areas new property tax appraisal values for the current year are established in May. Property value notices are sent out to property owners on the 1st or 2nd of May.  You can also look online at the appraised value set by your tax appraisal district by visiting their websites:  Tarrant County Appraisal District & Dallas County Appraisal District

You may protest the value on your property in the following situations:

  • the value the appraisal district placed on your property is too high
  • your property is unequally appraised
  • the appraisal district denied a special appraisal, such as open-space land, or incorrectly denied your exemption application
  • the appraisal district failed to provide you required notices
  • other matters prescribed by Tax Code Section 41.41(a)

Many districts will informally review your concerns and may try to resolve our objections without a formal hearing.  It is important, even if you think you may resolve your concerns at the informal meeting, to preserve your right to protest by filing your Notice of Protest before the May 31st deadline. 

Once your protest is received, the Appraisal Review Board (ARB) will notify you at least 15 days in advance of the date, time and place of your hearing.  You can appear in person, by affidavit or through an agent.  If you fail to appear, you may lose the right to be heard by the ARB on the protest and the right to appeal.

Be on time for your hearing and come prepared.  Present your information in a simple and organized manner.  Photographs and other documents may be helpful.  Take an appropriate number of copies so that each member of the ARB will receive one. 

After the hearing, the ARB will send their decision to you via certified mail.  If you disagree with the ARB’s decision, you have the right to appeal.  More information about the appeals process can be found at http://comptroller.texas.gov/taxinfo/proptax/protests.html.

Home prices in Texas are up 7.13% Over Last Year

The Federal Housing Finance Agency's latest Home Price Index (HPI) showed Texas prices are up 7.3% when compared to the same period last year.  However Texas is lagging behind the U.S. in price appreciation.

Nationally, prices increased 8.4 percent during the same period while Texas home prices increased 7.13 percent during the year ending in September according to the third quarter 2013 HPI, which was released late last week,.

The price appreciation in Texas being below the national average doesn’t tell the whole story.  Texas didn’t have the severe crash in home prices that other states had during the recent recession.

Here are how home price increases look for the major metro areas of Texas. Houston-The Woodlands-Sugar Land had the largest one-year price increase of the state's major metros at 10.31 percent.  Next Texas metro area was Austin-Round Rock at 10.08 percent followed by Dallas-Plano-Irving at 9.73 percent, San Antonio-New Braunfels at 7.67 percent, and Fort Worth-Arlington at 5.88 percent.

What are CCRCs Continuing Care Retirement Communities

When you or a family member is ready to move from their home to a retirement community there are a number of options depending on the level of services and care desired.  There are a range of community types including independent living, assisted living, memory care and skilled nursing that cater to residents who require different levels of care and services.  Continuing Care Retirement Communities (CCRCs) offer a variety of services within one community. CCRCs guarantee lifetime housing, social activities and increased levels of care as needs change.

CCRCs are part independent living, part assisted living and part skilled nursing home and offer a tiered approach to the aging process, accommodating residents’ changing needs. Depending on the community, when entering, healthy adults can reside independently in single-family homes, apartments or condominiums. As assistance with everyday activities becomes necessary, residents can move into assisted living or nursing care facilities. One of the benefits of these communities is they give older adults the option to live in one location for the duration of their life, with much of their future care already figured out. This can provide a great level of comfort to both residents and their families and that can take much of the stress out of the caregiving relationship.

There are three basic types of contracts for CCRCs:

  • Extended or Life Care Contract: This is the most expensive option, but offers unlimited assisted living, medical treatment and skilled nursing care without additional charges.
  • Modified Contract: This contract offers a set of services provided for a set length of time. When that time is expired, other services can be obtained, but for higher monthly fees.
  • Fee-for-Service Contract: The initial enrollment fee may be lower, but assisted living and skilled nursing will be paid for at their market rates.

Start your research on Continuing Care Retirement Communities in your area and if family members are available to accompany you, invite them on visits. While there, investigate thoroughly and meet with a representative who can walk them through the different housing options, cost structures and contract choices. Here is a checklist of things to look out for and ask while you’re visiting.

If you decide on a CCRC, a weekend or week-long stay at the facility to ensure it’s the right choice. Once ready to commit, run the contract by an attorney to be sure everything is spelled out as it was agreed upon with the facility.

Arlington Texas Gets Our First Link to Mass Transit

Starting August 19th, Arlington will begin our first link to metro area mass transit.  MetroArlingtonExpress a.k.a. MAX will run between College Park Center at UT Arlington (convenient to UTA and Downtown Arlington) and Trinity Railway Express (TRE) CentrePort/DFW Airport Station.  TRE connects to Fort Worth “the T” transportation and the Dallas “Dart” system.  MAX will run Monday through Friday about 6 am to 10 pm.  Oh, parking is free at College Park parking garage and you can take your bike on MAX.
